EXPERIENCE:
Brian concentrates his practice in the areas of media, First Amendment, privacy, and intellectual property litigation in state and federal courts throughout the country at both the trial and appellate levels. Brian represents media clients in litigation, including defamation and privacy cases addressing important First Amendment issues such as opinion, innocent construction, commercial speech, general and limited purpose public figure status, qualified and absolute privileges, and actual malice. He has extensive experience conducting pre-publication review of content, litigating on behalf of the press for access to court and governmental records, and advising the media on newsgathering matters.
He also advises clients on intellectual property matters, including the registration and maintenance of trademarks and copyrights, assignments and licensing, and e-commerce issues, such as domain name maintenance and protection, website terms of service, regulatory compliance, and other Internet-related matters.
Brian has hosted panels and given presentations at comic and pop-culture conventions across the country on legal issues faced by artists, writers, and publishers and has been a panelist on media topics for the American Bar Association’s Forum on Communications Law.
